Newborn Photography Session Contract and Model Release Form
Session Reservation Fee
*
1. The client understands and agrees to pay session fee within one (1) week of your pre-consultation to secure their appointment date and time. This is a non-refundable reservation fee, to secure the date and time of the appointment and for the photographer to not make any other reservations or accept any other clients for said date and time. For this reason, in the event that the client cancels the contract for any reason, all monies paid shall be retained by the photographer in order to offset its loss of business. The balance is due either one (1) week before your session date or as arranged per layby terms and conditions, unless the client pays in full at the time of booking.
Payment

2. The client understands that: All payments are due in full within one (1) week of booking/placing an order unless layby payment arrangements have been made. Orders will not be processed until payment in full is received. If client has arranged a payment plan, order will be placed after the final payment has been received.
Home Sessions
*
3. The client understands that: Home lifestyle sessions require a suitable environment in which to photograph in. Light is the most important aspect of our photography, and therefore the environment must be bright and light with big windows. The photographer requires large windows, preferably to the floor, as well as a clear white/off-white wall. The client must clear clutter from these areas, including the living room, nursery and bedrooms (if the client does not wish to have portraits in one or more of these areas they must let me know). It is very important the client follow the instructions given in their guide prior to their session time, just the same as they would when coming into the studio. Rescheduling home sessions will incur both a second travel fee, rescheduling fee, and/or a second session fee depending on the re-shoot decision.
Cancellation or Postponement of Booking

4. The client understands that: Where the client cancels or postpones a booking appointment, the client is LIABLE to and agrees to PAY a cancellation fee of $150, regardless of whether the appointment is attended or not. Where a booked appointment involves more than one person, it is the client's responsibility to ensure that everyone required arrives at the appointment on time. Failure of any person to arrive at the appointment on time will result in, at the photographers discretion, cancellation or postponement. The booking appointment and any fees paid prior to cancellation or postponement of the appointment are transferable to another person, as if it were the original person, as long as the booking is similar and the date and time of the appointment are not changed. No refunds will be given under any circumstances. The money paid to the photographer towards the booking/appointment can be applied towards another session to the value of the amount paid, at the photographer discretion.
Re-shoots / Refunds

5. The client understands that: Re-shoot requests may be granted, at the discretion of the photographer, should the client be unhappy with their gallery. If a re-shoot is requested and granted by the photographer, the previous session’s gallery will be deleted. The client will not be able to access the images from the previous gallery, and will be provided with a new gallery from the re-shoot. Should the client want to choose images from both the previous session and the re-shoot session, the client agrees to PAY a extra session fee for the re-shoot session. The re-shoot will in this case be deemed a separate shoot, and charged with an additional session fee. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair or weather related issues, or by not following the recommendations of the photographer. Refunds are given entirely at the discretion of the photographer. In most cases no refunds will be granted. If a refund is granted it will only be given in the form of a voucher the client may use or gift within twelve (12) months. No refunds are given in the form of cash.
Following The Prep Guide

6. The client understands that: Should the photographer need to reschedule due to the client not following the instructions provided in the information pack associated with the clients’ session type, the client is LIABLE for and agrees to PAY the $50 re-scheduling fee. The information pack is designed to best prepare the client and the clients children and/or newborn for their session. The instructions need to be followed correctly by the client in order for the photographer to provide the best outcome for the portraits. Should the client not cooperate fully with the instructions, resulting in the children and/or newborn being unable to finish the session, the photographer is unable to guarantee the number of images in the clients’ gallery. Should the client be unhappy with the number of images in the clients gallery, when non-cooperation has occurred, the photographer is not liable. The client can choose to pay the $50 re-scheduling fee for an incomplete session, or an additional session fee of $150 for a second re-shoot.

What the session fee includes

8. The client understands there are no digital files, or products included in your session fee. Your session fee covers the time and talent of both the photographer, the use of the photography studio, the use of the props available in the studio as well as the use of all of wardrobe, the wear and tear of the equipment used during your session, and the related expenses such as electricity and water (bathroom facilities). The client understand that there is a minimum spend requirement which covers the time and effort put into creating your beautiful gallery of images, from selecting, culling, editing, and finishing right through to presenting them in your gallery. The minimum spend allows the studio to cover business costs and guarantee sufficient income to keep the business running. Digital files are the art the photographer has produced, and are priced accordingly to the amount of effort put into each image.
Model Release

9. The client hereby assign(s) and grant(s) HAZEL&CASS and its legal representatives the irrevocable and unrestricted right to use and publish photographs of the client) or in which the client may be included, for editorial, trade, advertising or any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The client hereby releases HAZEL&CASS and its legal representatives and assigns from all claims and liability relating to the photographs. It is agreed that HAZEL&CASS may display and use the photographs taken for advertising, display, website and internet promotion, photographic contests, public display such as in photography books, studio display, magazine advertising and any other purpose thought proper by HAZEL&CASS.
Backup

Hazel&cass is not responsible for loss of images or for maintaining backups of the client's images once they have been delivered to the client.
Damage to Photographers Property

10. The client understands that:The client will be responsible for any damage caused to the property of the photographer and persons accompanying the photographer that arises from misuse, or destructive behaviour. General wear and tear is not the responsibility of the client, as these are covered in the session fee as set by the photographer, through normal use. Damage incurred by the client or accompanied persons that is caused by misuse, disrespect or destructive behaviour will be charged to the client to the value of repair or replacement of the damaged property. The client assumes responsibility of the accompanying persons, including guests and children the client brings to their session.
Abuse

11. The client understands that: here at Hazel&Cass I treat all client’s with the utmost respect, and ask that the clients and their family and guests do the same. Sadly, sometimes there is someone who goes out of their way to bully, harass, or be verbally or physically abusive to photography professionals. At no time and under no circumstances whatsoever shall illegal actions, intent to act on illegal actions, abusive, bullying, violent, destructive, menacing, harassing or verbally or physically abusive behavior be tolerated from the client or any party acting on behalf of the client. If the Client is or becomes unreasonable at any point or has an unreasonable family member, who attempts to bully, harass, verbally or physically abuse or extort the Photographer by any means OR the Client makes unreasonable requests, pertaining to any aspect of the booking, or to change their appearance beyond recognition, leaving the photographer to edit excessively in photoshop; the Photographer has the right to cancel the contract. If the Client is unable to control the conduct of themselves or their party, resulting in an unacceptable degree of misconduct, or if the conduct of any of their party damages or threatens to damage the equipment or reputation, of the photographer, it will be considered a contractual breach and result in the immediate departure of the photographer and release Hazel&Cass from future obligations. Editing will cease, no photographs will be given, and all images will be required to be removed from the photographers, the Clients, and their family and their friends, social media and websites. This terminates the relationship permenantly, with no further recourse by either party. At the Photographers discretion a full or partial refund be given the customer, taking into account the cost of works already carried out, with no further remuneration or reparation due.
Camera's and Picture taking during the Session

12. The client understands that: No cameras/camcorders/any type of recording device (this includes cell phone cameras) are allowed during the session unless prior arrangement has been made between client and photographer, including a written agreement. The photographer will not continue if there are other cameras or video taping during the session.
Arriving Early/Late

13. The client understands that: The session starts at the agreed upon time. If you arrive more than 15 minutes before your session, please stop by the cafe or other area to relax as I will not be ready to receive you. If you are running late please inform Cass 0212771987 as soon as you can. If you are more than 25 minutes late your session may be rescheduled, at the photographers discretion, should your session conflict with another booking on the same date due to running overtime from starting late. If hair & make up were arranged and your session is rescheduled due to being late, a new fee may be payable to reschedule the make up artist, this fee is at the photographer's and MUA's discretion.
Smoke-Free Environment

14. The client understands that: Our studio is used by pregnant women, newborns and children, and is therefore a smoke-free environment. No smoking is permitted on or near the studio property. Smoking is also not permitted near the photographer or anyone working with the photographer. Please refrain from smoking during your session, and for one (1) hour before your session. We are a non-smoking business and family and appreciate the respect given by not smoking around our persons, props, equipment and property.
Archive

15. The Client understands that: Orders must be placed at the ordering session. PURCHASED images will be archived for six (6) months, and any UNORDERED images will be DELETED. After six (6) months the photographer may purge their system and remove images older than six (6) months, in order to make room for new client galleries. There is a retrieval fee of $150 for all archived images. There is no guarantee the clients gallery will be available after six (6) months from the ordering session. The photographer is not responsible or liable for loss of images, nor the client’s loss of images.
